I used two weeks ago... why was I arrested today????
Governor Fallin has signed HB 1441 into law. This means that a person found to have any THC and/or its metabolites in his/her blood, saliva or urine, will be charged with DUI-D regardless of the time of last use.
This per se, or in fact, law is fraught with problems. A person driving a motor vehicle several days after getting high is obviously not "under the influence" nor a threat on the road (for that purpose).
Our Firm will have zero tolerance with this law and will vigorously defend our clients.
